The complaint alleges that during the Class Period defendants made false and misleading statements and/or allegedly failed to disclose that Tyson systematically colluded with several of its industry peers to fix prices in the broiler-chicken market; the foregoing conduct constituted a violation of federal antitrust laws; as a result, Tyson’s Chicken segment revenues during the class period were the result of illegal conduct.

On October 7, 2016, Pivotal Research downgraded Tyson Foods Inc from "buy" to "sell," citing concerns about a "powerfully convincing" class action against Tyson and some of its industry peers as defendants, alleging price collusion in the broiler-chicken market. According to the complaint, beginning of 2008, Tyson and numerous other companies conspired by sharing proprietary data and reducing production to support prices.

Following this news, NYSE: TSN dropped $6.63, or 8.91%, to close at $67.75 on October 7, 2016.
